Barney Frank Tosses Transsexuals Overboard On ENDA

October 12, 2007 – Massachusetts homosexual activist/legislator Barney Frank (D) has officially tossed his transsexual/drag queen/cross-dresser allies overboard on legislation designed to add these troubled individuals as federally-protected minorities.

At a press conference on October 11, Frank announced his intention to pursue a version of ENDA that does not explicitly contain “gender identity,” – code for drag queens, transsexuals, cross-dressers and she-males.

Frank’s press conference was supposedly only open to credentialed media, but Human Rights Campaign was the exception. They had staffers inside the conference room. All others were kept outside in the hallway.

“It is clear that Frank is giving HRC special preference over other homosexual/transgender groups,” said TVC Executive Director Andrea Lafferty. “I was in the hallway outside and could see the frustration on the faces of many who had been shut out of the press conference.”

Frank’s latest version, H.R. 3685, will be marked up in House Committee on Education and Labor on Thursday, October 18 – but this is subject to change. It is expected that it will be voted on in the House the week of October 22 (again, subject to change).

Tell-A-Friend!

A second bill, H.R. 3686, is the old H.R. 2015, which Frank had previously been pushing through the House. A hearing on this bill has not yet been scheduled.

H.R. 3685, supposedly weaker, still has significant problems for Christian business owners, school officials and others.

H.R. 3685 includes the terms “actual or perceived” in it. The term “perceived” provides homosexuals and transgenders far more protection than for African-Americans, Hispanics, women, or people of faith under Title VII of the Civil Rights Act of 1964.

In fact, “perceived” can be used by transgenders to claim protection under ENDA. In addition, this word also covers 30 different kinds of “sexual orientations” in ENDA. Any person who is a heterosexual, bisexual, or homosexual under ENDA, can also engage in a variety of sexual orientations and bizarre behaviors listed in the American Psychiatric Association’s Diagnostic and Statistical Manual Of Mental Disorders (DSM).

Christian business owners, schools, universities, day care centers and other faith-based enterprises are threatened by the phony religious exemption in H.R. 3685.

Phony Religious Exemption

The bill supposedly exempts a “religious organization” from ENDA, but will still cover religious enterprises that are not directly attached to a religious denomination. The exemption also supposedly protects religious groups that are involved in the “propagation of a religion.”

In a legal analysis done for Traditional Values Coalition, lawyers have analyzed H.R. 3685 and have concluded: “… ENDA still has substantial implications to the operations of faith-based entities that do not qualify as a ‘religious organization.’ In fact, substantial litigation exposure will result to such entities where it is not clear if they meet the test of qualifying as a ‘religious corporation, association, or society.’ Moreover, with respect to faith oriented religious institutions, it is unclear what constitutes ‘propagation of a religion.”

The lawyers also point out: “… Christian schools or universities that are not controlled, managed, or owned or supported by a denomination, religious corporation, association or society likely would still be covered under the modified version of ENDA. Similarly, independent nursing homes, child care facilities, publishing facilities and advocacy groups, even those with specific religious objectives, likely would still be covered under the modified version of ENDA.”

Business Owners Beware -- ENDA Is Litigation-Producing Legislation

The major business associations such as NFIB, the U.S. Chamber of Commerce, National Association of Manufacturers, National Restaurant Association and others have basically sold out their members.

Little to nothing has been done by these associations to protect their members from or to alert their millions of members to the dangers of ENDA. Business owners have no idea what kind of litigation nightmare is about to hit them. Even though gender identity has been removed from the bill, ENDA’s “perceived” sexual orientation prong would be the subject of extensive and protracted litigation.

Tell-A-Friend!

Conclusion: Barney Frank’s H.R. 3685 will still result in the persecution of people of faith and provide federally-protected status for cross-dressers, drag queens, transsexuals, and she-males. It will also protect the 30 sexual orientations listed by the APA in the DSM.

Both versions of ENDA must be defeated.
